OIL PAINTED PORTRAIT COMMISSION AGREEMENT
PROCEDURES
Initial Consultation
An initial 45-minute design consultation is included. This meeting may be held on the same day as the photo shoot or before booking. During this session, the artist will discuss:
Wardrobe
Lighting
Hair styling (artist is not responsible for hairstyling but can recommend stylists upon request)
Potential display location of the painting
Photo Session
The portrait photo session will take place on (date): //____. Subjects must arrive with clean, dry, and styled hair. The artist will review the photos with the client to finalize the pose and overall design of the portrait. This consultation should not exceed 45 minutes and may be conducted in the artist’s studio or via phone.

Preliminary Sketch Approval
Once the preliminary sketch is complete, the client will review and approve it before painting begins.
Approval ensures there is agreement on the chosen pose, composition, orientation, and size.
A resemblance may not be fully evident until the final painting is completed.
Completion & Delivery
The final painting is typically completed within three months of starting.
Upon completion, the client will review the painting and approve it before delivery.
Artwork can be picked up from the artist’s studio or delivered for an additional fee.
FEES & PAYMENT
Base Commission Price:
$_________ (Prices listed in brochures and on the website are subject to change but are fixed upon receipt of a signed contract and a 50% deposit.)
Deposit & Payment Schedule:
A $200 non-refundable deposit is required to secure the photo session and must be paid along with the signed contract.
Prior to starting the initial drawing, a second payment of 50% of the base price plus applicable travel expenses is due.
The remaining balance, including applicable sales tax and travel/shipping fees, is due upon completion of the portrait.
Deposits made up to 50% after drawing approval are non-refundable.
Additional Fees:
Consultation Overages: If the consultation exceeds 45 minutes, additional time is billed at $150 per hour, rounded up to the nearest hour.
Travel Fees:
Clients 20 miles outside of Daytona Beach Florida: $5 per mile per trip.
Basic travel: $50 flat fee.
Airfare and hotel charges, if applicable, will be billed separately.
Photo Session Fees:
First hour is included.
Additional time or delays due to client tardiness: $50 per hour.
Photo reshoot due to client dissatisfaction with the subject’s appearance: $100.
Reshoot for reasons beyond the artist’s control (e.g., illness, allergies, braces, etc.): $100
Additional Consultation or Online Review of Photos: $100 plus travel fees.
Photo Change After Drawing is Completed: $400 for a new drawing.
Size Change After Drawing is Completed: $400 plus additional costs based on updated portrait size.
Digital Files:
Full set of 10-15 retouched images: $250.
Individual image file: $75 per image.
Shared Print Rights for Portrait: $250.
Framing Not Included:
A presentation mat is available for non-custom sizes under 18x24” but should be replaced with an archival mat when framed.
Hand Delivery: $150 plus travel fees.
Shipping & Handling: Additional cost based on location and size.
Copyright & Usage Rights
The artist retains all copyrights under the Federal Copyright Act of 1976 and the Federal Visual Rights Act of 1991.
Purchasing the artwork does not transfer copyright or reproduction rights.
Clients may not reproduce, modify, distribute, or alter the work without the artist’s written permission.
Any transfer of copyright must be in writing and explicitly state the rights being sold.
